Permanent water-saving rules are always in place to help us use water efficiently.  Water corporations sometimes use water restrictions to help manage urban water use.

A Water Use Plan controls the use of water for specific purposes or for a specific stage of restrictions. It helps you maximise your water-savings during restrictions.

In special circumstances, you can request an exemption from some permanent water-saving rules or a stage of water restrictions.

If these circumstances apply to you, you can apply for an exemption.

To submit an exemption for residential pools or spas you will need to upload either:

  • receipts for water saving products you've purchased
  • a Victorian Building Authority (VBA) Compliance Certificate

A VBA Compliance Certificate is issued for plumbing work that follows the relevant plumbing standards for Victoria. Only a licensed plumber can issue this certificate. For more information, visit the Victorian Building Authority website.

Documents required

A Garden of Significance (GoS) is a public or private garden with significant botanic, environmental or historic qualities. The garden must be at least one of the following:

  • listed on a national or state-wide register.
  • important to the local community because of its unique or diverse plant life.
  • ingrained in the life of the local community.

To successfully complete this application you'll be asked to supply:

  • at least one photo of the garden
  • any supporting documents that explain the garden's trees and plants in more detail.

You'll need these documents ready as you'll be asked to upload them as part of this application.

You'll also need access to the last three years of your water usage.

You can use your bills for the past three years to calculate your annual water consumption (in kilolitres) for each year.

A Water Use Plan application for a commercial car wash will only be considered if the application is on behalf of a business, a company, an industry, or a commercial or institutional organisation.

Water Use Plan application for residential pools or spas 

Unless granted an exemption, a residential pool or spa can't be filled up during water restrictions or outside of the set times outlined under permanent water-saving rules. To be considered for an exemption, you must complete a Water Use Plan application.

A residential pool or spa means a privately used swimming pool or spa, which may be inside or outside.  

This Water Use Plan application shows how you'll save water each year. The amount you save should be the same as what you need to fill or top up your pool or spa.   

How we'll assess your application

A Residential Pool or Spa Water Use Plan will only be approved if: 

  • the water use described in the plan is allowed under the relevant stage of restrictions 
  • the Water Use Plan is part of a water restriction exemption application 

When approving Water Use Plans and exemptions we'll consider our Water Restriction By-Law  and Drought Preparedness Plan. 

Under the By-Law, we'll need to be reasonably satisfied that the requested use of water will: 

  • lead to water savings that are equal to the predicted water savings under the relevant stage of restrictions 
  • not (in combination with other Water Use Plans) have a significant impact on the daily demand for water or water security 
  • be generally supported by other South East Water customers who are affected by the relevant stage of water restrictions 
  • demonstrate best practice or a highly efficient use of water 
  • provide a broader public benefit

Water Use Plan application for a commercial or public pool or spa 

Unless granted an exemption, a commercial or public pool or spa can't be filled up during water restrictions or outside of the set times outlined under permanent water-saving rules. To be considered for an exemption, you need to complete a Water Use Plan application.  

A commercial or public pool or spa is an indoor or outdoor pool or spa that is either:

(a) for public use and operated by (or on behalf of) a public statutory body  

(b) for limited public use and operated by (or on behalf of) a school or educational facility

(c) for limited public use for physical rehabilitation and operated by (or on behalf of) a public statutory body or a private company.

How we'll assess your application

A Commercial or Public Pool or Spa Water Use Plan will only be approved if: 

  • the water use described in the plan is allowed under the relevant stage of restrictions 
  • the Water Use Plan is part of a water restriction exemption application

Water Use Plan application for playing surfaces (sportsgrounds or ovals)

Unless granted an exemption, when watering playing surfaces you need to follow permanent water-saving rules and any additional rules that are in place during water restrictions. You can find more information about watering playing surfaces on our website.

To be considered for an exemption, you need to complete a Water Use Plan application. The plan must outline how you plan on reducing the amount of water you are using across your facility.  

A playing surface is any outdoor area that's used for organised sport or recreation.  A playing surface means:

(a) a soft-fall area at a child-care facility or public playground

(b) any of the following at a sporting or recreational facility:

  • a turf wicket for competition cricket or a turf wicket for practicing cricket (only if an alternative practice wicket that does not require watering (such as a synthetic wicket) is not available)
  • a lawn or other type of running track, for use by humans or animals
  • a baseball or softball diamond, including the infield and any clay (en tous cas) running area
  • a hockey or lacrosse pitch
  • a green for lawn bowls, croquet or similar sport
  • the penalty areas of a soccer pitch
  • a golfing tee or green (but not fairways or approaches)  

This application does not cover watering tennis courts. If you're watering a tennis court you need to complete a Water Use Plan application for a tennis club. To do this, go back to the previous page and  select tennis club when asked about the type of exemption or Water Use Plan you need. A Water Use Plan for a tennis club  includes lawn, clay (en tous cas), or any other type of tennis court other than a concrete, bitumen or asphalt. 

This plan is intended to be used by owners and managers of sports fields where sport is played (including councils, schools and private sport fields).

How we will assess your application

A Water Use Plan for playing surfaces (sportsgrounds or ovals) will only be approved if: 

  • the water use described in the plan is allowed under the relevant stage of restrictions 
  • the Water Use Plan is part of a water restriction exemption application. 

 Schools are encouraged to provide evidence of water saving efforts within the school, like participation in the Schools Water Efficiency Program (SWEP). 

When approving Water Use Plans and exemptions South East Water will take into consideration its Water Restriction By-Law  and Drought Preparedness Plan.

Under the By-Law, South East Water will need to be reasonably satisfied that the requested use of water will: 

  • lead to water savings that are equal to the predicted water savings under the relevant stage of restrictions 
  • not (in combination with other Water Use Plans) have a significant impact on the daily demand for water or water security 
  • be generally supported by other South East Water customers who are affected by the relevant stage of water restrictions 
  • demonstrate best practice or a highly efficient use of water 
  • provide a broader public benefit.

Water Use Plan application for a tennis club

Unless granted an exemption, a tennis club must follow the permanent water-saving rules and any additional rules that are in place during water restrictions. You can find information about watering your tennis courts on our website.

Exemption to water a Garden of Significance

Unless granted an exemption, the watering of a Garden of Significance must follow the permanent water-saving rules and any additional rules that are in place during water restrictions. In some circumstances, you can apply for an exemption to the permanent water-saving rules or water restrictions. To be considered for an exemption, you must complete this application form. 


A Garden of Significance (GoS) is a public or private garden with significant botanic, environmental or historic qualities. The garden needs to be at least one of the following: 

  • listed on a national or state-wide register. 
  • important to the local community because of its unique or diverse plant life. 
  • ingrained in the life of the local community. 

When we're assessing your exemption request, we'll use the information in the water restriction by-laws and our Drought Preparedness Plan to decide whether to give you an exemption.  

We’ll assess applications based on the information provided by you in this form and any additional information attached separately.  

The assessment criteria have been developed in conjunction with the University of Melbourne's Burnley Horticultural College.

Water Use Plan application for a commercial car wash

Unless granted an exemption, a commercial car wash needs to follow the permanent water-saving rules and any additional rules that are in place during water restrictions. To be considered for an exemption, you need to complete a Water Use Plan application.

A commercial car wash is any commercial facility used for washing any type of vehicle. A vehicle includes a car, boat, truck, airplane or any other vehicle that is propelled or moved. Your car wash needs to demonstrate compliance with Environmental Protection Authority (EPA) Victoria trade waste discharge requirements.

How we'll assess your application

A Commercial Car Wash Water Use Plan will only be approved if:

  • the water use described in the plan is allowed under the relevant stage of restrictions  
  • the Water Use Plan is part of a water restriction exemption application

Application for a Dust Suppression Water Use Plan

Unless an exemption is granted, using water for dust suppression needs to follow the permanent water-saving rules and any additional rules that are in place during water restrictions. Under water restrictions, using water to suppress dust is only allowed if you have a Water Use Plan.

Water Use Plan application a nursery or market garden

Unless granted an exemption, a nursery or market garden needs to follow the permanent water-saving rules and any additional rules that are in place during water restrictions. To be considered for an exemption, you must complete a Water Use Plan application.

A nursery or market garden is any area that is used primarily to propagate, cultivate or harvest fruit, vegetables, vines or other plants for sale and distribution.

A Nursey or Market Garden Water Use Plan will only be approved if:

  • the water use described in the plan is allowed under the relevant stage of restrictions

A residential pond or lake includes any collection of water for ornamental or urban drainage retention purposes. It doesn't include a fountain, water feature or tank that's used to house fish or other aquatic life.

  • it is part of an application for an exemption.

Certain personal situations and water use are exempt from permanent water-saving rules. There are specific forms available for specific types of exemptions, like a medical exemption. Use this form if your proposed water use does not fit under any of the specific exemption types.

General exemption application for non-residential water use

Unless granted an exemption, non-residential water use needs to follow the permanent water-saving rules and any additional rules that are in place during water restrictions. Non-residential water use includes water use by:

  • businesses
  • companies
  • industry
  • commercial or institutional organisations
  • councils
  • schools and clubs.  

For non-residential water use to be considered for an exemption, you need to complete an exemption application There are specific forms available for specific kinds of exemptions, like for construction or hard surface cleaning. Use this form if your proposed water use does not fit under any of the specific exemption types.

Exemption to water new warm season grass

If you're planting warm season grass you can apply for an exemption to the permanent water-saving rules or water restrictions.

Warm season grass requires less water than other types of grass and usually take four weeks to establish a root network. Once established, warm season grass is resilient and doesn’t need much watering.  

A 28-day exemption allows new warm season grass to be watered outside of the watering times set under water restrictions or permanent water-saving rules. The exemption helps establish warm season grass so households can invest in the long-term water efficiency of their garden.

The exemption only applies to watering new warm season grass. After the exemption period ends, you're subject to the current stage of restrictions or permanent water-saving rules. Under these rules, you’re not allowed to water grass using a watering system during the day.

When we're assessing your exemption request, we'll use the information in the water restriction by-laws and our Drought Preparedness Plan to make our decision.

Important information

You need to complete this application form at least one week before the date you'd like to commence watering, to ensure we have enough time to process your application.  

Once approved, the exemption is valid for 28 days and may be cancelled or changed at any time. The exemption is only valid once you receive a certificate from us.

Each section of new warm season grass must have its own exemption. So if you're applying for exemptions for your front and back yard, you need to apply for two exemptions; one for your front yard and one for your back yard.

Once you receive the certificate, you must print and display the exemption certificate so passers-by can clearly see it.  

After the exemption expires, watering must be done according to the current stage of water restrictions or permanent water-saving rules.  

By granting this exemption, we don't guarantee the survival of the new grass.  

Watering your grass regularly in the first four weeks will help it establish roots. It's a condition of this exemption that you remove any existing lawn before planting warm season grass. You can find information on removing pre-existing grass at your local nursery or online.

Exemption to water a residential garden or lawn outside of set times

In some circumstances, you can apply for an exemption to the permanent water-saving rules or water restrictions.

The permanent water-saving rules are a set of rules that reduce demand for water and make sure we use water efficiently across Victoria. These rules are always in place and are the same across Victoria. 

Water restrictions 

Water restrictions are sometimes used by water corporations to help manage urban water use when water supplies are low. There are four stages of restrictions, from mild (stage one) to severe (stage four). 

When water restrictions are in place additional rules apply. You need to follow both the additional water restriction rules and permanent water-saving rules. There are penalties for breaking these rules. 

Water restrictions only apply to drinking water. They don't apply to recycled water, reclaimed water, rain water or grey water, unless these are supplemented or topped up by drinking water.

(a) Supplied drinking water cannot be used to fill a new or existing:

  • residential or commercial pool or spa; or
  • public pool or spa,

with a capacity of 2,000 litres or less, except by means of:

  • a hand-held hose, bucket or watering can; or
  • an Automatic Water Top Up Device.

(b) Supplied drinking water cannot be used to fill a new or existing:

  • residential or commercial pool or spa; or
  • public pool or spa,

with a capacity of greater than 2,000 litres, except in accordance with an approved Water Use Plan.

c) Supplied drinking water cannot be used to top up a new or existing:

  • residential or commercial pool or spa; or
  • public pool or spa,

of any capacity, except by means of:

  • a hand-held hose, bucket or watering can; or
  • an Automatic Water Top Up Device.

(d) Supplied drinking water cannot be used to fill or top up a mobile spa except in accordance with an approved Water Use Plan that is obtained by the owner of the mobile spa.

(e) Supplied drinking water cannot be used in or for the use of a hose-connected water toy at any time.

Stage 2 (Save)

(a) Supplied drinking water cannot be used to fill a new or existing:

  • residential or commercial pool or spa; or
  • public pool or spa,

with a capacity of 2,000 litres or less, except by means of:

  • a hand-held hose, bucket or watering can; or
  • an Automatic Water Top Up Device.

(b) Supplied drinking water cannot be used to fill a new or existing:

  • residential or commercial pool or spa; or
  • public pool or spa,

with a capacity of greater than 2,000 litres, except in accordance with an approved Water Use Plan.

(c) Supplied drinking water cannot be used to top up a new or existing:

  • residential or commercial pool or spa; or
  • public pool or spa,

of any capacity, except:

  • between the hours of 6am and 8am and 6pm and 8pm on alternate days by means of a hand-held hose, bucket or watering can; or

  • by use of an Automatic Water Top Up Device at any time; or
  • in accordance with an approved Water Use Plan.

(d) Supplied drinking water cannot be used to fill or top up a mobile spa at any time.

cannot be watered with supplied drinking water except as required and then only:

  • with a hand-held hose, bucket or watering can any time; or
  • using a watering system but only on alternate days between the hours of 6am and 8am and 6pm and 8pm.

(c) Despite paragraphs (a) and (b):

  • a public garden or lawn area; or
  • a general or particular playing surface,

can be watered with supplied drinking water as required but only in accordance with an approved Water Use Plan.

Stage 3 (Just Enough)

(a) A:

  • residential or commercial lawn area; or
  • public lawn area; or
  • general playing surface,

cannot be watered with supplied drinking water at any time.

(b) A:

  • residential or commercial garden area; or
  • public garden area; or
  • particular playing surface,

cannot be watered with supplied drinking water except as required and then only on alternate days between the hours of 6am and 8am:

  • with a hand-held hose, bucket or watering can; or
  • using a dripper watering system.

(c) Despite paragraphs (a) and (b):

  • a public garden or lawn area; or
  • a general or particular playing surface,

can be watered with supplied drinking water as required but only in accordance with an approved Water Use Plan.

  • at a commercial car wash in accordance with paragraph (d); or
  • in the case of a vehicle for mass transportation, in accordance with an approved Water Use Plan.

(b) Despite paragraph (a), supplied drinking water can be used to clean inside a food transport vehicle if it is necessary, either to avoid contamination of the vehicle’s contents or to ensure public health or safety, but only by means of:

  • a high-pressure water cleaning device; or
  • a hand-held hose, bucket or watering can.

(c) Supplied drinking water cannot be used at the premises of or by a motor vehicle dealer, repairer or detailer to clean a vehicle except:

  • by means of:
    • a high pressure water cleaning device;
    • a commercial car wash in accordance with paragraph (d); or
    • a bucket or watering can; or
  • in accordance with an approved Water Use Plan.

(d) Supplied drinking water cannot be used to wash vehicles at a commercial car wash unless:

  • for those car washes built prior to 1 July 2012, no more than 100 litres of water is used for each vehicle washed; and
  • for those car washes built on or after 1 July 2012, no more than 70 litres of water is used for each vehicle washed; or
  • the use is in accordance with an approved Water Use Plan.

(e) Supplied drinking water cannot be used to flush the inboard or outboard motor of a boat or other vessel unless:

  • a suitable receptacle filled by a hand-held hose is used; or
  • a flushing device, connected to a hose is used, and the tap is turned off immediately after flushing is complete.

(a) Supplied drinking water cannot be used to clean a vehicle except:

(b) Supplied drinking water cannot be used to suppress dust unless:

  • there is no suitable alternative source of water that it is reasonably practicable to use; and
  • the dust is causing or is likely to cause a health or environmental hazard,

and then only:

  • by means of a hand-held hose, bucket or watering can; or
  • with supplied drinking water from a water tanker filled or topped up in accordance with restriction 4(b); or
  • in accordance with an approved Water Use Plan.

(c) Supplied drinking water cannot be used in the course of construction or renovation except:

  • by means of a high-pressure cleaning device, hand-held hose, bucket or watering can; or
  • for the suppression of dust in accordance with paragraph (b); or

  • drinking by animals or birds; or
  • cleaning animals or birds; or
  • cleaning pens, yards and cages, and then only if cleaning is done by means of a hand-held hose or bucket.

(d) Supplied drinking water cannot be used for cooling a shed on a commercial poultry farm except by means of:

  • sprinklers used only for cooling and then only between the hours of 6am and 9pm when the inside temperature of the shed is 30oC or higher; and
  • fogging systems and cooling pads, which may be used at any time.

Permanent water-saving rules

The permanent water-saving rules are a set of rules that reduce demand for water and make sure we use water efficiently across Victoria. These rules are always in place and are the same across Victoria.

Water restrictions

Water restrictions are sometimes used by water corporations to help manage urban water use when water supplies are low. There are four stages of restrictions, from mild (stage one) to severe (stage four).

When water restrictions are in place additional rules apply. You need to follow both the additional water restriction rules and permanent water saving rules. There are penalties for breaking these rules.

Water restrictions only apply to drinking water. They don't apply to recycled water, reclaimed water, rain water or grey water, unless these are supplemented or topped up by drinking water.

1. Self-assessment

Undertaking a self-assessment helps you responsibly manage your water use. You must know how much water you use in your washing process to make sure that you will become or remain compliant during water restrictions.

Your self-assessment should show us how much water you use at each stage of a standard wash. Use the amounts from each of the stages to calculate a total water use.

There are three methods of calculating how much water you use at each stage of a wash.

  1. You can read the water meter before and after a wash. This is called the meter read method.
  2. You can measure the amount of water used in a container, like a water drum. This is called the volumetric method.
  3. You can use the flow rate and time to calculate the water usage. This is called the theoretical method.

2. Independent audit

An independent audit checks that your self-assessment is accurate and reliable.

A licensed plumber must perform an independent audit. After the audit, the plumber must provide a letter on their letterhead and quote their Plumbing Industry Commission license number.

If you have automated equipment onsite, including any fixed bay washing, your audit needs to be done by a qualified auditor with a mix of quality assurance and hydraulic design (engineering) skills.

3. Signage

Putting up signage around your commercial car wash will help members of the public understand how you are using water and reduce complaints about your water use. Complaints may be directed to you or your water corporation and may result in unwarranted investigations.

  • must be at least A3 sized
  • must always be visible
  • should include: 'This car wash is working with water restrictions under an approved Water Use Plan to save water' or a variation of this.
